According to Section 609 of the Illinois Marriage and Dissolution of Marriage Act, “the court may grant leave, before or after judgment, to any party having custody of any minor child or children to remove such child or children from Illinois whenever such approval is in the best interests of such child or children.”

  • Better employment opportunities and quality of life
  • Transfer of employment to another state
  • Remarriage (new spouse lives outside of Illinois)

The custodial parent will have to prove to the court that the move is in the best interest of the child. In the case of a temporary removal, the custodial parent may also have to comply with a plan to return the child or children to the state.
